One Momoh Alfred, who was arraigned on Tuesday May 21, 2019, for
conspiracy and larceny by servant, was granted bail by Magistrate Hannah
Bonnie, presiding at Court No.1.
It was alleged that the accused on Friday April 26, 2019, at 287 Bai Bureh Road, Calaba Town conspired with other persons unknown to commit larceny by servant, and that the accused being a servant of an Indian National stole the sum of Le56 million, property of Deepak Aruja.
While testifying in court, the witness Deepak Aruja said that the accused is one of his laborers and recalled Friday April 26, 2019. He said on the day of the said incident, he came to his shop at around 9am to do business, when one of his suppliers came to collect his money. He said he went to check the drawers where he kept the money but could not find it. “There was no breakage and I become suspicious,” he said.
He said he went to check the CCTV camera at the shop and from the footage he saw that the accused had hidden in the shop since on April 25, 2019.
Aruja said that the following morning he saw him coming out of the shop carrying a chair on his head but with no money or bag. He said he started investigating how the money got missing and he saw a strange man came and took the thrash away.
He said the accused identified the stranger who took away the thrash as his neighbour. Upon that the witness called Assistant Superintendent of Police Bongay and showed him the footages.
He said he made statement at the Calaba Town Police Station, adding that the matter was sent to CID for investigation and later charged to court.
Defense Lawyer, A.S Ndolleh made an application for bail on behalf of his client, noting that they realized the seriousness of the allegation levied against the accused and that they have reliable sureties.
He said granting the accused bail does not mean he has been set free, and that bail is the discretion of the magistrate. He said they will not interfere with the prosecution witnesses, and that the accused has a fixed abode.
He also stated that the accused is not a flight risk.
Magistrate Hannah Bonnie submitted that there is nothing before her as an affidavits indicating that the accused should not be granted bail. ”, she said. The accused was granted bail in the sum of Le 100 million, two sureties to be gainfully employed and holders of NASSIT identification cards. The bail should be approved by the Deputy Master and Registrar.
The matter was prosecuted by A.S.P I.S Mansaray.
